1. Purpose and scope
These terms and conditions apply to any booking of a surf, yoga and wellness stay with SeaGnature, made on the website www.seagnaturesurf.com, by email, by WhatsApp or by any other means. Any booking implies full and unreserved acceptance of these terms by the client.
The terms in force are those published on the website on the date of booking. A dated copy is sent to the client with their booking confirmation.
2. The stay
Each stay is described on its dedicated page on the website: dates, duration, accommodation, number of surf and yoga sessions included, meals, transfers and additional activities. This description forms an integral part of the contract.
SeaGnature reserves the right to adapt the program (session times, surf spot, instructor) according to weather, swell, tide or safety considerations, without this constituting a substantial change to the stay or a right to a refund, provided the number of sessions included in the package is broadly honoured over the course of the stay.
3. Booking, deposit and balance
3.1 Deposit
A booking becomes firm upon receipt of a deposit of 20% of the total stay price, paid at the time of booking.
This deposit is non-refundable, except in the cases provided for in Article 8 (cancellation by SeaGnature), or in case of a contrary legal obligation in the client's country of residence.
3.2 Balance
The balance of the stay (remaining 80%) is due no later than 30 days before the arrival date. For a booking made less than 30 days before arrival, the full price is due immediately.
If the balance is not paid by the due date, SeaGnature reserves the right to cancel the booking, with the deposit remaining non-refundable.
3.3 Payment methods
Bank transfer, card payment. Any bank charges related to international payment are borne by the client.
3.4 Currency and prices
Prices are shown in euros. They include all the services mentioned on the stay's page and exclude flights, travel insurance, personal expenses and anything not explicitly listed.
4. Modification and cancellation by the client
4.1 Date changes
A request to reschedule to other dates may be accepted, subject to availability, up to 14 days before arrival, with no fee other than any price difference. Beyond this period, a reschedule is treated as a cancellation (Article 4.2).
4.2 Cancellation
In the event of cancellation by the client:
| Time before arrival | Amount withheld |
|---|---|
| More than 30 days | 20% deposit (non-refundable, Article 3.1) |
| Between 30 and 14 days | 50% of the total price |
| Less than 14 days, or no-show | 100% of the total price |
4.3 Recommended insurance
SeaGnature strongly recommends that every client take out, before departure, travel insurance covering cancellation, repatriation, medical expenses and risk sports (surfing is sometimes classified as a risk activity: please check with the insurer). SeaGnature does not sell insurance and is not responsible for the client's lack of or insufficient coverage.
5. Modification and cancellation by SeaGnature
SeaGnature may cancel or substantially change a stay in the event of force majeure (natural disaster, government restriction, extreme safety conditions) or an insufficient number of participants for certain group packages.
In the event of cancellation by SeaGnature not related to a fault of the client, the client is offered, at their choice:
- a reschedule to a later date, at no cost, or
- a full refund of amounts paid, including the deposit.
SeaGnature cannot be held liable for the client's incidental costs (flight tickets, other bookings) not covered by insurance.
6. Weather guarantee and surf conditions
Surfing depends on natural conditions (swell, wind, tide) that SeaGnature does not control. The following points apply:
- The number of surf sessions stated in the package is a commitment of effort over the total duration of the stay, not for each day taken in isolation. If a session is cancelled on a given day for safety reasons (strong wind, no usable waves, weather alert), it is rescheduled to another time during the stay wherever possible. Other activities may be offered to make up for surf sessions that could not take place.
- If, at the end of the stay, the number of sessions actually delivered is lower than the number included in the package for weather or safety reasons attributable to natural conditions, SeaGnature offers, at the client's choice: a make-up session during a future stay within 12 months, or a partial credit calculated pro rata to the missed sessions.
- SeaGnature does not guarantee wave size, good weather, or any particular weather during the stay, and no refund is due on the sole grounds of weather deemed disappointing by the client as long as the contractual number of sessions is honoured.
- The decision to maintain, adapt, postpone or cancel a session for safety reasons rests exclusively with SeaGnature's instructors and management; it is final.
7. Health, physical fitness and safety
7.1 Declaration of good health
The client declares to be in good physical condition and not to suffer from a medical condition (cardiac, respiratory, musculoskeletal, or other) incompatible with surfing, yoga or outdoor physical activity in a hot climate. In case of doubt, the client is advised to consult a doctor before booking.
The client informs SeaGnature, at the time of booking or before arrival, of any medical condition, serious allergy, or ongoing treatment that may require special attention or an adaptation of the program, so that the team can take it into account within reasonable limits. This information remains confidential and is used solely for the client's safety and comfort during their stay.
7.2 Level and supervision
The client agrees to follow the instructions of surf instructors and yoga teachers, not to overestimate their level, and to report any physical discomfort during an activity. SeaGnature arranges groups by level but cannot guarantee the absence of any risk inherent to surfing (falls, contact with the board, currents, etc.) and yoga (postures).
7.3 Minors
Any minor (aged 16 and above) must be accompanied by a legal guardian or be the subject of prior written parental authorisation, according to the terms communicated by SeaGnature.
8. Liability waiver and equipment
8.1 Nature of the activity
The client acknowledges that surfing, yoga and related activities involve inherent risks, including but not limited to: falls, drowning, injuries related to the board, fins or leash, sunburn, heatstroke, unpredictable currents and waves.
8.2 Limitation of liability
To the extent permitted by applicable law, SeaGnature, its employees and its instructors cannot be held liable for bodily, material or other damage suffered by the client as a result of their participation in surfing, yoga or any other activity offered, except in the case of proven gross or intentional negligence on the part of SeaGnature or its staff.
8.3 Lent or rented equipment
Equipment provided by SeaGnature (boards, fins, leash, wetsuits, yoga mats, etc.) remains the property of the establishment. The client agrees to take care of it and use it in accordance with the instructions given.
- Normal wear and tear (scratches, minor dings from reasonable use): borne by SeaGnature.
- Breakage or loss resulting from negligence, use not in accordance with instructions, or an accident occurring while the client was using it: the cost of repair or replacement (broken board, lost fin, torn wetsuit, etc.) is borne by the client, according to the price list posted on site or communicated before the stay. No deposit is requested on arrival; such costs, if applicable, are invoiced at the end of the stay according to the applicable price list.
- The client is advised to check whether their travel insurance (Article 4.3) covers this type of damage.
9. Diet and allergies
In order to adapt the meals included in the stay, the client is asked to indicate, no later than 7 days before arrival, via the booking form or by email:
- their diet (vegetarian, vegan, gluten-free, other);
- any food allergy or intolerance, as precisely as possible.
SeaGnature strives to accommodate these requests to a reasonable extent, given the resources available locally. In the absence of a declaration submitted within this period, SeaGnature cannot guarantee a complete adaptation of meals and cannot be held liable for the consequences of an allergy not reported in advance.
For any severe allergy (risk of anaphylactic shock), the client is asked to report it explicitly in writing and to travel with their own emergency treatment.
10. Travel information and transfers
If a transfer from or to the airport (or another station) is included in the package, the client agrees to provide, no later than 7 days before arrival:
- their flight (or bus/train) number and expected arrival time;
- the same information for the return journey, as soon as it is known.
If this information is not provided within the stated period, SeaGnature cannot guarantee the transfer will be arranged at the expected time, and additional charges may apply if a last-minute transfer has to be organised.
In the event of a flight delay or cancellation communicated in advance, SeaGnature will make reasonable efforts to adapt the transfer time at no additional cost.
11. Arrival, departure and house rules
- Check-in: from 2:00pm. Check-out: before 11:00am.
- The house rules (noise, respect of common areas, alcohol consumption, smoking, pets) are communicated to the client on arrival and form an integral part of the contract.
- SeaGnature reserves the right to end a client's stay, without refund, in the event of behaviour endangering their own safety or that of others, or serious breach of the house rules.
12. Image and communication
Unless the client objects in writing before or during their stay, SeaGnature may take photographs and videos during activities and use them for promotional purposes (website, social media, marketing materials), without financial compensation. The client may request the removal of content featuring them.
13. Personal data
Data provided by the client (identity, contact details, diet, relevant health information, flight number) is used solely for the management of the booking and the stay, and is not passed on to third parties other than necessary service providers (payment, transfer). The client has the right to access, rectify and delete their data, exercised by email to [email protected].
14. Complaints
Any complaint relating to the stay should, where possible, be reported during the stay, to allow SeaGnature to respond immediately. A written complaint may also be sent within 30 days of the end of the stay to [email protected].
15. Governing law and disputes
These terms and conditions are governed by Moroccan law. In the event of a dispute, the parties will endeavour to find an amicable solution before any legal action. Failing an amicable agreement, the competent courts are those of the city and region of Agadir, subject to mandatory consumer-protection provisions applicable to European Union consumers or other, where applicable.
16. Acceptance
By reading these terms and conditions when booking online, or by paying the deposit provided for in Article 3.1, the client acknowledges having read, understood and accepted these terms and conditions without reservation.
